Intel Helper Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Intel Helper iOS application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Matthew Davies (daviesgeek) (“we,” “us,” “our,” “Developer”).

2. Description of Service

Intel Helper is an iOS application that provides an enhanced interface for the Ingress Intel Map. The App offers:

Access to the Ingress Intel Map in a native iOS wrapper
Bookmark management for map locations
Location-based map positioning
In-app purchase option to remove advertisements (“Pro” upgrade)

IMPORTANT DISCLAIMER: Intel Helper is an independent, unofficial application and is not affiliated with, endorsed by, or associated with Niantic, Inc., Ingress, or Google. The App provides a wrapper interface for the publicly available Ingress Intel Map but is developed and maintained independently by Matthew Davies.

3. Third-Party Service Dependency

3.1 Ingress Intel Map

The core functionality of the App depends on the Ingress Intel Map, which is owned and operated by Niantic, Inc.:

You must have a valid Ingress account and Google account to use the Intel map
Your use of the Intel map is subject to Niantic’s Terms of Service
We have no control over the availability, functionality, or content of the Ingress Intel Map
Niantic may change, suspend, or discontinue the Intel map at any time without notice to us
If Niantic restricts access to the Intel map, the App’s functionality may be limited or cease to work

3.2 Other Third-Party Services

The App integrates with additional third-party services:

Google AdMob: Advertising service (removable with Pro purchase)
Firebase Crashlytics: Crash reporting and analytics
Apple StoreKit: In-app purchase processing

Each service has its own terms and conditions, which you are responsible for reviewing and accepting.

4. Eligibility and Age Requirements

You must be at least 13 years of age to use this App, consistent with:

Niantic’s Ingress game age requirements
Apple’s minimum age for app usage
Children’s Online Privacy Protection Act (COPPA) compliance

If you are under 18, you must have permission from a parent or legal guardian to use the App and make any in-app purchases.

By using the App, you represent and warrant that you meet these age requirements.

5. Account and Device Responsibility

5.1 Your Account

You are responsible for maintaining the security of your Ingress/Google account
You are responsible for all activities that occur when using the App with your account
You must notify us immediately of any unauthorized use of your account

5.2 Your Device

You are responsible for maintaining your iOS device and ensuring it meets minimum requirements
You are responsible for maintaining your internet connection
You are responsible for any data charges incurred while using the App

6. Acceptable Use

6.1 Permitted Use

You may use the App for its intended purpose: accessing and interacting with the Ingress Intel Map through an enhanced iOS interface.

6.2 Prohibited Conduct

You agree NOT to:

Use the App in any way that violates Niantic’s Terms of Service or Ingress game rules
Attempt to circumvent, disable, or interfere with security features of the App
Reverse engineer, decompile, or disassemble the App (except as permitted by law)
Use the App for any automated or scripted access to the Ingress Intel Map
Remove, obscure, or alter any copyright, trademark, or proprietary notices
Use the App to transmit malware, viruses, or harmful code
Attempt to gain unauthorized access to any systems or networks
Use the App for any illegal or unauthorized purpose
Violate any applicable local, state, national, or international law
Share, sell, or transfer your in-app purchases to other users

7. Intellectual Property Rights

7.1 App Ownership

The App, including its code, design, user interface, and documentation, is owned by Matthew Davies and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

7.2 Third-Party Intellectual Property

“Ingress” and related trademarks are owned by Niantic, Inc.
Google and related trademarks are owned by Google LLC
We claim no ownership over third-party content displayed through the App

7.3 User Content

Bookmarks and preferences you create in the App remain your property. By using the App, you grant us no rights to this content, as it is stored locally on your device.

8. In-App Purchases

8.1 Pro Upgrade

The App offers an in-app purchase (“Pro” upgrade) that:

Removes advertisement banners
Unlocks premium features
Is processed through Apple’s App Store

8.2 Purchase Terms

All purchases are processed by Apple and subject to Apple’s terms
Purchases are non-refundable except as required by law or Apple’s refund policy
Purchases are tied to your Apple ID and device
We are not responsible for Apple’s processing of payments
Prices are subject to change with notice

8.3 Subscription and Restoration

The Pro upgrade is a one-time purchase, not a subscription
You can restore purchases on multiple devices using the same Apple ID
Contact Apple Support for billing or refund issues

9. Advertisements

The free version of the App displays advertisements through Google AdMob:

Ads are served by Google and subject to Google’s advertising policies
We are not responsible for ad content or advertiser practices
You can remove ads by purchasing the Pro upgrade
Clicking ads is at your own risk; we do not endorse advertised products

10. Privacy and Data

Your use of the App is subject to our Privacy Policy, available at: https://daviesgeek.com/Apps-Projects/Intel-Helper/privacy-policy

Key points:

Data is stored locally on your device only
We do not collect, store, or sell your personal information
Third-party services (Niantic, Google, Firebase) have their own data practices
Location data is used locally for map positioning and not transmitted to us

11. Disclaimers and Limitations of Liability

11.1 “As Is” Provision

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Uninterrupted or error-free operation
Accuracy or reliability of information

11.2 No Guarantee of Availability

We do not guarantee that:

The App will always be available or accessible
The Ingress Intel Map will remain accessible through the App
The App will work on all devices or iOS versions
Updates will be provided or maintained indefinitely

11.3 Third-Party Service Disclaimer

We are not responsible for:

Changes to the Ingress Intel Map by Niantic
Niantic’s terms, policies, or enforcement actions against your account
Third-party plugin functionality or security
Google AdMob ad content or practices
Apple’s processing of in-app purchases

11.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATTHEW DAVIES (DAVIESGEEK) SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruptions or data loss
Damages resulting from your use of the App or inability to use the App
Any claims arising from Niantic’s suspension or termination of Ingress access
Damages caused by third-party services, plugins, or advertisements

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (INCLUDING IN-APP PURCHASES) IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

Some jurisdictions do not allow limitations on implied warranties or liability, so some of these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Matthew Davies (daviesgeek) from any claims, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of Niantic’s Terms of Service
Your violation of any third-party rights
Any content you create or share through the App

13. Termination

13.1 Termination by You

You may stop using the App at any time by:

Uninstalling the App from your device
Discontinuing access to the App

Uninstalling the App will delete all locally stored data (bookmarks, settings).

13.2 Termination by Us

We reserve the right to:

Discontinue the App at any time without notice
Terminate or restrict your access if you violate these Terms
Cease updates, support, or maintenance

13.3 Effect of Termination

Upon termination:

Your license to use the App immediately ends
You must stop using the App and delete all copies
We are not obligated to provide refunds for in-app purchases
Provisions regarding liability, disclaimers, and indemnification survive termination

14. Updates and Modifications

14.1 App Updates

We may release updates to:

Fix bugs and improve performance
Add new features
Maintain compatibility with iOS versions
Comply with legal requirements

Updates may require acceptance of revised Terms. Continued use after updates constitutes acceptance.

14.2 Changes to Terms

We reserve the right to modify these Terms at any time. When we do:

We will update the “Last Updated” date
Significant changes will be communicated through the App or our website
Continued use after changes constitutes acceptance

If you do not agree to modified Terms, you must stop using the App.

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of the United States and the state in which the Developer resides, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

Informal Negotiation: Contact us at ingressintelhelper@daviesgeek.com to attempt resolution
Binding Arbitration: If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules
No Class Actions: You agree to resolve disputes individually, not as part of a class action

15.3 Exceptions

The following may be brought in court:

Small claims court actions
Injunctive relief to protect intellectual property rights

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

16.5 No Agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.

16.6 Apple Requirements

As required by Apple’s App Store terms:

Apple is not a party to these Terms
Apple has no obligation to provide support for the App
Apple is not liable for any claims related to the App
In the event of third-party claims that the App infringes intellectual property, we (not Apple) are responsible

17. Acknowledgment

BY USING INTEL HELPER, YOU ACKNOWLEDGE THAT:

You have read and understood these Terms of Service
You agree to be bound by these Terms
You understand the App is unofficial and not affiliated with Niantic or Ingress
You accept the risks associated with third-party service dependencies
You are responsible for compliance with Niantic’s Terms of Service
You understand the limitations of liability and disclaimers
